RENTAL LISTING AGREEMENT TO: THE LANDIS COMPANY, REALTORS

1. AUTHORIZATION & DURATION THE LANDIS COMPANY, hereafter referred to as the AGENT is hereby authorized to offer for rent the property described on the attached form according to the terms and conditions listed. Agent's authority shall begin upon the signing of this agreement.

2. PAYMENT OF RENTS: Agent shall receive on behalf of the OWNER/LANDLORD all payments of rent and security deposits required pursuant to the OWNER/LANDLORD'S directions. All such funds paid to and received by the Agent shall be deposited in the Agent's trust account prior to disbursement. Rental payments received by the Agent will be disbursed to the OWNER/LANDLORD, within 15 days, less the Agent's commission as provided for in this agreement.

3. AGENT'S FEE: OWNER/LANDLORD warrants ownership of the property and authorizes the Agent to execute agreements on behalf of the OWNER/LANDLORD of rent payments in advance. The OWNER/LANDLORD agrees to pay the Agent a professional service fee of ELEVEN PERCENT (11%) of the gross rental on any lease secured by the Agent. Gross rental includes rent and utility charges but DOES NOT include security deposits. All payments are to be received by the Agent and Agent's fee is to be deducted from each payment as it is received. The Agent's fee is solely for the purpose of securing tenants and does not include property management services.

4. ADW/SECURITY DEPOSITS Owner/Landlord acknowledges that either a security deposit or ADW is included in all leases and there are certain required responsibilities for all parties. If the owner or tenants identify a claim for accidental damage both parties are required to notify the Agent by phone immediately. Upon notification, the Agent will go to the property and verify the damages and when possible, the inspector will provide an estimate for repair or replacement of the damaged items. The owner will assist the Agent in identifying damaged items and provide the Agent with a written estimate and original costs and age of the damaged items within 7 days. Owner, if unavailable will instruct their cleaner to notify the Agent when damages are found to the property.

5. BUSINESS RELATIONSHIP THE LANDIS COMPANY and it's authorized representatives are working as a LANDLORD'S Agent. NON-EXCLUSIVE LISTING: Please provide us the names of any other agents who are representing you. This will eliminate duplicate rentals.

As OWNER/LANDLORD, you have the right to individually reach an agreement on any fee, commission or other valuable consideration with any broker. No agency, trade association or Multiple Listing Service. Nothing contained herein is intended to prohibit an individual broker from independently establishing a policy regarding the amount of fee, commission or other valuable consideration to be charged in transactions by the broker.

6. EMERGENCY REPAIRS: In the event the property owner cannot be contacted in advance, THE LANDIS COMPANY is authorized to contract with a reputable contractor for the purpose of making any emergency repairs up to $250.00.

7. KEYS: Owner authorizes The Landis Company to lend keys to this rental property to owner authorized service and repair people and unaccompanied potential tenants for the sole use of previewing the property for rental. Instructions will be given to all parties to return keys to The Landis Company the same day they are given out.

8. Owner's signature on page two (2) indicates agreement and acceptance to all terms and conditions of this rental listing agreement and receipt of the Attorney General s document on New Jersey Law against Discrimination and Federal Fair Housing Laws which can be found at http:/www.njar.com/story/199

The undersigned acknowledge that they have read all three (3) pages of this Listing Agreement and warrant the accuracy of all statements and information contained herein. The undersigned certifies that this agreement is the entire and only agreement between the parties and cancels any previous agreements. This agreement can only be changed by a contract in writing signed by all parties.

IMPORTANT: PURSUANT TO CONTRACT LAW, WE CANNOT PROCESS ANY LISTING AGREEMENT UNLESS IT IS SIGNED.
